§1
General conditions
    These Regulations applies to visit and use of the Flotea Portal belonging to Flotea Sp. Z.o.o. registered at the District Court in Wroclaw - IX Commercial Division, KRS no 0000417514, NIP 611-272-64-55, hereinafter referred to as Flota or Party
  • 1. In these Regulations, the following terms have the following definitions:
    • a. "Personal Information" means any personal data provided by the User, including name and surname, e-mail address, picture, address, phone number;
    • b. "Confidential Information" means all information classified in this way by either Party, whether in writing or other way, including all information related to the activities, projects, products and services, production, trade secrets, expert knowledge (know-how ), staff, customers and suppliers of the Parties, or an entity associated with the Party, including any information that reasonably be considered confidential for the relevant Party;
    • c. "Account" means a collection of resources and permissions, which is created by the User upon registration in the Service and is assigned to a specific User;
    • d. "Amount" means the gross amount in PLN currency;
    • e. "Traveler" means a customer of transport services;
    • f. "Portal" means an Flotea website available at https://flotea.pl and its sub-pages and sites linked located on Flotea servers;
    • g. "Copyright" or any reference to intellectual property means inter alia: patents, trademarks, service marks, logos, trade names, Internet domain names, design rights, copyrights (including rights for computer software), moral rights , the database, rights of the registration of topographies of integrated circuits, utility models and other rights of intellectual property, regardless of whether they are registered, and including applications for their registration and any other rights or forms of protection that are similar in nature or equivalent effect in every place in the world;
    • h. "Carrier" means a provider of transport services;
    • i. "Party" means Flotea and / or the User, according to the circumstances, and "Parties" means Flotea and User;
    • j. "Content" means any presented or displayed content, including, inter alia: logos, icons, trademarks, text, graphic text, graphics, photographs, images, videos, sounds, pictures, music, software (excluding Portal), opinions , notes, comments, graphic design, questions, suggestions, information and other materials;
    • k. "Flotea Content" means content owned or used by Flotea, its affiliates or licensors, made available by the Portal or Services, including any Content licensed by third parties, with the exception of User Content;
    • l. "User Content" means Content that User publish, sends, delivers or transmits to share in the Portal or through the Services;
    • m. "Shared Content" means together Flotea Content and User Content;
    • n. "Agreement" means the clauses 1-49;
    • o. "User" means the Traveler and the Carrier, who use the services;
    • p. "Service" means the provision of information and the resources to use by the Travelers from transport services provided by carriers through the Portal, including inter alia search of transport services, purchase and sale of tickets from carriers.
§2
Provision of services
  • 1. Using the Portal constitutes acceptance of these Terms and Conditions by the User.
  • 2. In order to use the Services by the Carrier, you must first register on the Portal.
  • 3. In order to use the Services by the Traveler registration is voluntary.
  • 4. Flotea does not provide transport services and is not an intermediary in the sale of carriers tickets. Flotea provides a tool to offer ticket sales for free. Flotea service is provided by the transfer of cash from a passenger to the carrier.
  • 5. Provision of transport services shall be subject to agreement between Carrier and the Traveler, and Flotea is not a party to that agreement.
  • 6. User declares that he has over 18 years of age or the age is not limited to use of the Services because of the jurisdiction under which it is located.
  • 7. The user undertakes to
    • a. use the Service only for its own use;
    • b. not transfer, not authorize, not rewrite or in any way not to give the ownership of his account to any third parties and to maintain the confidentiality of data access to his account;
    • c. not use another account without Flotea authorization;
    • d. not use the Service for illegal purposes and to comply with all applicable laws;
    • e. not use the Service to unfair, annoying or any other purpose, that would cause inconvenience or difficulties;
    • f. not obstruct the proper functioning of Service, including traffic generation and transfer for purposes other than use of the Service;
    • g. not copy and disclose any content contained on the Portal;
    • h. provide proof of identity to Flotea where appropriate, in conjunction with Clause 6.
    • i. In case of violation the provisions of Clause 7, Flotea reserves the right to terminate the Agreement with User with immediate effect.
§3
Payments and reservations
  • 10. Use of the Service is free of charge. Flotea reserves the right to introduce a fee for the use of the Services to the provisions of Clause 46.
  • 11. Current rates for transport services are located in the Portal and the passenger is obliged to obtain information on the current rates before booking.
  • 12. At the time of booking an appropriate amount of money will be charged from Traveller's bank account. Reservations will not be made in the absence of authorization or lack of resources on the Traveller's payment card.
  • 13. The data on the payment card are not stored by Flotea and are not made available to the Carrier.

  • 15. Traveler currently can not change the date of travel through Flotea.
  • 16. Traveler can return ticket to 24 hours before traveling via the Portal and the collected money will be returned to the Passenger in the amount of 71.4% after deducting administrative costs and commissions of Flotea by external support payments.
  • 17. Order Confirmation will be sent to the Traveler via the Portal and / or by sending appropriate message to an e-mail of the Traveler. This confirmation will include the reservation number and travel data.
  • 18. Acceptance or rejection of the reservation by the Traveler is the responsibility of the Carrier without any Flotea intervention.
  • 19. Personal information such as e-mail address, phone number, name and surname of the User to the extent necessary to provide transport services are transferred to the Carrier.
  • 20. Through the provision of services Flotea undertakes to make reasonable efforts to allow the traveler to contact with the Carrier in connection with the reservation.
§4
Responsibility
  • 21. Any content contained on the Portal for informational purposes only. Flotea will make every effort to ensure that Flotea contents are correct, accurate and up to date, but can not guarantee that the Flotea content will be free of errors, defects, malware and viruses, and that the information will be correct, accurate and up to date.
  • 22. Flotea is not liable for any damages resulting from the use or inability to use the Service, including damage caused by malware and viruses, and any irregularities associated with the Flotea Content, referred to in Clause 21.
  • 23. Flotea shall not be liable in particular for any damages related to access to Service, including transmission of data between User and the Service, including any failure, delay or interception or manipulate data by third parties or malware and viruses.
  • 24. Without limiting Clauses 21-23 and insofar as this is possible in accordance with Polish law, the total responsibility of Flotea will not exceed in any case the amount of 100 PLN (one hundred zloty).
  • 25. Overall responsibility for transport services shall be borne by the Carrier. Flotea under no circumstances be liable related and / or resulting from the transport services provided by the Carrier, nor is it liable for any deeds, actions, behavior, progress and / or negligence attributable to the Carrier. Therefore, any complaints regarding the transport services provided by the Carrier should be addressed directly to the Carrier.
§5
Release of liability
  • 26. At the moment of concluding this Agreement, the User agree to defend Flotea and release it, its affiliates, licensors and all its officers, directors, other members, employees, representatives and agents from any liability for any claims, costs, damages, losses, liabilities and expenses ( including all costs and fees for lawyers) resulting from / being in connection with:
    • a. violation or breach by the User of any of the terms contained in this Agreement or any laws or regulations, regardless of whether they are mentioned in this Agreement;
    • b. violation of any rights of third parties by the User, including carriers;
    • c. use or misuse by the user using the Service.
§6
Privacy Policy
  • 27. The data administrator is Flotea.
  • 28. Because the Service is not intended for persons under 18 years of age, these people can not register to use the Service or share the Personal Data. Flotea is not collecting personal information from anyone under 18 years of age knowingly.
  • 29. In order to proper Service performance User visiting Portal provides, among others, the IP address, pages visited and their time and duration, information about the web browser, system and screen resolution. In order to improve the user experience, you can provide, among other things your geographical location. Sharing the information described in this Clause by the User is equivalent to the User's consent to the processing of information by Flotea.
  • 30. During or after the registration, the User provides personal data. Flotea will use this information for the correct Service performance, to contact the User to verify the e-mail address and password, for responses to inquiries and notices on the User Service. Flotea will use this information to set up and manage user accounts.
  • 31. Flotea may engage third parties to assist or provide Service on behalf of Flotea, among other things, at the implementation of payments or support the User. These sites will have access to your personal information only to perform these tasks and will not share and not use the Personal Data for any other purpose.
  • 32. Flotea may share the User personal data for the purpose required by Polish law on the basis of a court decision or in accordance with the guidelines of the regulator body, to which Flotea subject.
  • 33. User has the right to access the personal data that the User released during or after registration. User has the right of correction or deletion of individual data via the form available in the footer in the Contact section.
  • 34. Unless otherwise stated in these Rules, Flotea will store User personal information until you delete the Account / or the application that you want to delete the account and in the case of inactivity of account for a minimum period of 1 (one) year.
  • 35. Unless the law or other regulations do not require to keep the user's personal data after removing the account, the data will be anonymised by Flotea.
  • 36. Flotea takes all reasonable precautions to safely store the personal data on servers Flotea using accepted standards. Flotea however, can not guarantee the security of the database and capture all the information, including User Content and Personal Data during transmission between Flotea and the User. Each transmission of such information is made on risk of the User.
  • 37. For the proper provision of Service it may be necessary to use cookies, which is a text file placed on computer, mobile or other device of the User. The user can accept or not accept the use of cookies through appropriate settings in browser.
§7
Copyright
  • 39. The User undertakes that any User Content entered by the user to the Portal does not violate any patents, copyrights, trade secrets or other rights of third parties, and are non-confidential and non-proprietary information. In the case and the extent to which such information include materials owned by third parties, the User ensures that is licensed or authorized by the owner to the appropriate use of such materials, and may grant a sublicense Flotea to such information.
  • 40. The User assigns Flotea non-exclusive, royalty-free right to use, copy, distribute and disclose to third parties any User Content for any purpose, using any medium and throughout the world.
  • 41. The user can not use, copy, modify, alter, create derivative works, distribute, grant a license, sell, perform a transfer, perform publicly, reproduce, transmit, broadcast streaming, broadcast or otherwise use the Site, Services or Common Content, subject to the Provisions of These Regulations CONTAIN explicit consent. The user can not re-use the Common Content without the prior written consent Flotea. The user is not granted by any licenses or rights by implication or otherwise provided for intellectual property rights owned or controlled by Flotea or its licensors, except for licenses and rights expressly granted by this Agreement.
§8
Confidential Information
  • 42. The Parties acknowledge that any Confidential Information obtained or concerning the second side, with the exception of User Content is owned by the Party. Hereby the Parties undertake to:
    • a. Party will use Confidential Information exclusively for the Purpose of this Agreement;;
    • b. Party will not disclose Confidential Information to a third party without the prior written consent of the other Party;;
    • c. Party shall take all reasonable precautions necessary to ensure that any Confidential Information remains confidential and is not disclosed for any other purpose than these Regulations; and
    • d. Party especially do not use Confidential Information to obtain business or customer from the other Party, or to obtain a competitive advantage.
  • ON THE CONDITION that the above provisions do not apply to any information that:
    • e. it is or will be made publicly available without breach of Clause 42;
    • f. it is in possession of the relevant side without restrictions to the disclosure, which came into possession of the information before the date of receipt of the other Party;
    • g. it is received from a third party, which legally came into its possession and is not subject to restriction of its disclosure;
    • h. it is independently acquired by the Party without prejudice to the Confidential Information of the other Party; and / or
    • i. It is required to disclose on the basis of court order, or by Flotea in accordance with the guidelines of the regulatory body, which covers Flotea.
  • 43. In case of violation by a Party of the provisions of Clause 41-42:
    • a. Party will be obliged to pay a penalty in the amount of 10 000 PLN (ten thousand zloty) for each time breach within 14 (fourteen) days of receipt of a request from the other Party. Order for payment should contain accurate description of the circumstances and the way to make the breach;
    • b. the obligation to pay the contractual penalty specified above shall not preclude the possibility to claim damages exceeding the amount of the penalty.
§9
Reklamacje. Jak i gdzie składać
  • 44. Użytkownik może kontaktować się z Flotea w sprawie usług świadczonych drogą elektroniczną na podstawie niniejszego Regulaminu w formie:
    • a. pisemnej na adres: Flotea Sp. z o.o Tuwima 4, 58-573 Piechowice
    • b. za pomocą formularza kontaktowego znajdującego się w zakładce KONTAKT po uprzednim kliknięciu w odnośnik KONTAKT w stopce strony Flotea
    • c. na adres e-mail: reklamacje@flotea.pl
  • 45. W przypadku, gdy zdaniem Pasażera/Przewoźnika usługi świadczone na podstawie Regulaminu nie są realizowane przez FLOTEA bądź są realizowane niezgodnie z postanowieniami Regulaminu, może on złożyć zastrzeżenia w sposób określony poniżej jako reklamacja. Jednocześnie w przypadku sprzedaży własnej biletów i udostępnianej przez Flotea Użytkownik może zgłosić Reklamację w sposób opisany w treści Oferty Flotea.
  • 46. Reklamację można złożyć w formie elektronicznej za pomocą formularza kontaktowego lub pisemnej. Reklamacja powinna zawierać co najmniej nazwę, pod jaką Użytkownik występuje we FLOTEA (login / adres email), oraz opis zgłaszanych zastrzeżeń.
  • 47. FLOTEA przed rozpatrzeniem Reklamacji, zwraca się do składającego Reklamację o jej uzupełnienie we wskazanym zakresie, jeżeli podane dane lub informacje, o których mowa w art. § 9 wymagają uzupełnienia.
  • 48. FLOTEA rozpoznaje Reklamację w terminie 14 dni od daty jej otrzymania z zastrzeżeniem art. §9 gdzie termin jej rozpoznania rozpoczyna się od daty otrzymania prawidłowo uzupełnionej Reklamacji.
  • 49. Odpowiedź na Reklamację wysyłana jest wyłącznie na adres e-mail przypisany do Konta danego Użytkownika. W szczególnie uzasadnionych przypadkach FLOTEA może wysłać odpowiedź na inny adres wskazany przez składającego Reklamację. adres e-mail, który nie jest przypisany do Konta Użytkownika, lub na pisemnie adres wskazany w Reklamacji.
§10
Ochrona danych osobowych
  • 50. Administratorem danych osobowych Użytkowników będących osobami fizycznymi, w rozumieniu Ustawy z dnia 29 sierpnia 1997 r. o ochronie danych osobowych (tj. Dz. U. z 2016 roku, poz. 922 ze zm.), jest Flotea Sp. z o.o
§11
Ograniczenia
  • 51. Zabrania się jakichkolwiek działań potencjalnie lub faktycznie utrudniających lub uniemożliwiających prawidłowe działanie portalu. Zdanie poprzedzające stosuje się odpowiednio w przypadkach działania faktycznie lub potencjalnie na szkodę Flotea, w szczególności negatywnego wpływu na wizerunek portalu lub dobre imię Flotea. W przypadku takiego postępowania po stronie Użytkownika, Flotea zastrzega sobie prawo do podjęcia odpowiednich działań zmierzających do naprawienia zaistniałej szkody.
  • 52. Użytkownikowi korzystającemu z portalu Flotea zabrania się pobierania do wtórnego wykorzystywania w jakimkolwiek celu całości lub części bazy danych portalu Flotea.
  • 53. Za naruszenie postanowień niniejszego Regulaminu uważa się również działania lub zaniechania zmierzające do jego obejścia.
§12
Final Provisions
  • 54. The user may revoke the acceptance of these Terms and Conditions by the removal of the account. Such removal of an Account is equivalent to removing the acceptance of Terms and Conditions by the User.
  • 55. Flotea reserves the right to make changes to these Rules and to inform the User about such changes within 30 (thirty) days before the implementation of such changes. If the User do not agree for such changes, he delete the acceptance of these Regulations in accordance with the provisions of Clause 44.
  • 56. Upon expiration or termination of this Agreement by either Party:
    • Flotea shall immediately remove Your personal data in the area, which does not interfere with existing and future transportation services purchased by the User and in compliance with the Polish law; and
    • other provisions contained in Clauses 1-48 or elsewhere, having the nature of the continuation or the entry into force upon the expiration or termination, remain valid after termination or expiration of this Agreement and shall be in full force and their scope.
  • 57. Polish text of these Rules is the only original text. In the event of any discrepancy between the Polish text and the translation into another language, the text will be binding in the Polish language.
  • 58. These Regulations
    • a. constitutes the entire understanding and agreement between the Parties concerning the subject matter of this Agreement;
    • b. it is regulated and interpreted in accordance with Polish law and the parties hereby submit to the exclusive jurisdiction of Polish courts.
  • 59. Carrier Regulations
    • a. By accepting the terms and conditions of Flotea, passenger declares that he has read the rules of the carrier who sells ticket.
